“In Arizona, and the United States, the people elected Joseph Biden as President on November 3, 2020,” the indictment reads. Prosecutors in Michigan, Georgia and Nevada also have brought criminal charges against some of the people who signed on as fake electors in those states. A grand jury empaneled in Maricopa County, Arizona, to investigate efforts to overturn the 2020 election results in the state met this week before Mayes announced the charges. The fake electors for Trump convened at the state Republican Party headquarters in Phoenix on December 14, 2020. But in the weeks that followed, some of the fake electors continued to push for Pence to reject the legitimate Democratic slate of electors.

US government agencies are already banned from using Kaspersky Lab software but action to prevent private companies from using the software would be unprecedented. It’s the latest US government effort to use its vast regulatory powers to prevent Americans from using popular technology that US officials consider a national security risk. A Kaspersky Lab spokesperson did not respond to questions about a potential prohibition or about how big the company’s market share is in the US. Commerce Department officials have to carefully consider how practical any such regulation would be for the department to enforce and for users to comply with. But the expected move from the Biden administration would go a step further by using Commerce Department authorities to prevent private companies from using Kaspersky Lab software.

A gag order against one of Trump’s biggest foes could score political points and help him and his co-defendants in the short term. Then, McAfee appeared to suggest a gag order may be necessary. “I don’t know a reason to have a gag order right now,” Parker told CNN. CNN —Former President Donald Trump was dealt two major setbacks Thursday in his efforts to derail the criminal cases against him, with judges in the Georgia election interference case and in the federal classified documents case both rejecting bids by the presumptive 2024 GOP presidential nominee to have those cases thrown out. Trump has made similar presidential immunity arguments in the Georgia case and in the classified documents case. She wrote that prosecutors “make no reference to the Presidential Records Act” in the indictment against Trump and did not “rely” on the statute to bring charges. McAfee’s ruling is the latest step inching the state racketeering case against Trump forward. McAfee’s refusal to scrap the indictment comes as the free speech defense has repeatedly fallen short in pretrial wrangling in election meddling cases.

Inside the courtroom, Trump has been admonished and threatened with removal for being disruptive. Outside the courtroom, Trump has repeatedly railed against the charges he faces in front of cameras and attacked all of those involved on social media. Engoron issued a gag order on commentary about court staff that covered his clerk, fining Trump twice for breaking it. CNN —Former President Donald Trump and several of his co-defendants in the Georgia election subversion case are appealing a judge’s ruling that let Fulton County District Attorney Fani Willis remain on the election subversion case. The defense attorneys on Friday asked the Georgia Court of Appeals to overturn Judge Scott McAfee’s initial decision that allowed Willis and her office continue to pursue the case but only if Nathan Wade, the special prosecutor with whom she had a romantic relationship, resigned. While Wade has since left the case, defense attorneys still want the appellate court to disqualify the entire Fulton County DA’s office. “DA Willis has covered herself and her office in scandal and disrepute, as she has squandered her credibility and repeatedly and flagrantly violated the heightened ethical standards demanded of her position,” the appeal states. However, the judge added, “Georgia law does not permit the finding of an actual conflict for simply making bad choices – even repeatedly.”The district attorney’s office declined to comment.

CNN —A former Trump 2020 campaign official has been subpoenaed by officials in Arizona as part of the criminal investigation focused on efforts to overturn Joe Biden’s win, according to two sources familiar with the matter. The official, Mike Roman, is also one of Donald Trump’s co-defendants in the Georgia election subversion case. He’s being subpoenaed by prosecutors as part of a separate state-level probe overseen by Arizona Attorney General Kris Mayes, a Democrat. The subpoenas suggest the probe is accelerating ahead of the 2024 presidential election, when Trump is expected to again face Biden as the Republican nominee. Among those who have been interviewed by Arizona prosecutors in recent months is pro-Trump attorney Kenneth Chesebro.

CNN —Fulton County District Attorney Fani Willis said Saturday that “the train is coming,” referring to her team’s preparation for the case against former President Donald Trump and his 14 co-defendants and whether she was slowed down by attempts to remove her from the case. I do think there are efforts to slow down this train, but the train is coming,” she said while attending an Atlanta-area Easter basket giveaway. On Wednesday, Fulton County Superior Court Judge Scott McAfee granted requests from Trump and his co-defendants to appeal the decision to allow Willis to continue prosecuting the case. CNN —The judge presiding over the Georgia election subversion case against Donald Trump and several co-defendants said Monday that the district attorney who brought the case could be disqualified if she financially benefitted from a personal relationship with her lead prosecutor on the case. Trump and his co-defendants are also seeking to get the entire case dismissed. “The state has admitted a relationship existed,” McAfee said. “The issues at point here are whether a relationship existed, whether that relationship was romantic or non-romantic in nature, when it formed and whether it continues,” McAfee said. While McAfee said Willis may not be the first witness called on Thursday, he did not rule out the possibility of Willis taking the stand.

Washington CNN —Special counsel Robert Hur released a searing report Thursday that concluded President Joe Biden willfully retained and disclosed classified military and national security information but recommended he not face charges after a yearlong investigation into his handling of classified documents. According to the report, Biden – during the 2023 interview – did not remember when his son Beau died nor the years he was vice president. The special counsel report found that Biden willfully retained classified information, including top secret documents, and knew he was in possession of some documents as far back as 2017. House Oversight Committee Republicans, who have separately investigated Biden’s handling of classified documents, criticized Hur’s report before it was even released or delivered to Congress. “Most notably, after being given multiple chances to return classified documents and avoid prosecution, Mr. Trump allegedly did the opposite.” Hur wrote. “Among the places Mr. Biden’s lawyers found classified documents in the garage was a damaged, opened box containing numerous hanging folders, file folders, and binders,” the report said. “As there is no factual basis that could reasonably justify requiring opposing counsel and other employees to be a witness in the case, the State respectfully requests that the Court quash each of the subpoenas served,” Willis wrote. Among the Fulton County staff subpoenaed are Executive District Attorney Daysha Young and Deputy District Attorneys Sonya Allen and Dexter Bond. Despite calls by some legal experts to recuse herself from the case to protect its integrity, she is not expected to do so, the sources told CNN. Still, a source familiar with the thinking inside the DA’s office told CNN they would be “mystified” if it succeeds in removing her. “I think a lot of what I’ve read is more of a distraction and not legally substantive,” James told CNN in a sit-down interview. I think it’s very unlikely that we’ll see any criminal action come out of that,” Kreis told CNN. If Willis ultimately survives the current push to disqualify her, the case would effectively be back on track, sources told CNN.
